Neutral Citation No. - 2025:AHC-LKO:4767 Court No. - 8 Case :- WRIT - C No. - 703 of 2025 Petitioner :- Urmila Devi Respondent :- Sub Divisional Magistrate, Tehsil Tulsipur, Balrampur And Others Counsel for Petitioner :- Perdeep Kumar Tripathi Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the office of Chief Standing counsel. Sri Pankaj Gupta learned counsel has accepted notice on behalf of the respondent no.5. A preliminary objection has been raised by the learned counsel for the State respondent as well as counsel for the Gaon Sabha that the petitioner has filed instant petition against the order dated 19.12.2024 passed in proceedings under Section 24 of the U.P. Revenue Code 2006 and it is urged that against the said
order the petitioner has a statutory remedy of filing an appeal under Section 24(4) of the Code, 2006.
Learned counsel for the petitioner, after arguing at some length, however, could not dispute the fact that the petitioner has a statutory remedy of appeal. Accordingly, this Court is not inclined to entertain the petition which is dismissed on the ground of statutory remedy available to the petitioner. It is made clear that the petition has been dismissed solely on the ground of alternate remedy and the petitioner has a liberty of assailing the order in terms of statutory remedy.
