Heard learned counsel for the petitioner and learned Standing Counsel. 2. The present petition has been filed with the following prayer: "(i) Issue a writ order in the nature of MANDAMUS commanding and directing the concerned opposite parties to remove the illegal encroachment upon the public utility land having Gata no.2198 / 0.1010 hect. recorded in the revenue record as Naveen Parti situated in Village - Tribhuvan Nagar Grint, Tehsil Sadar, District opposite party no. 5. Gonda and take necessary action against opposite party No.5." 3. Learned Standing Counsel, based upon the instructions, states that the proceedings for removal have already been initiated. He further states that even the petitioner is under illegal occupation. 4. In view of the said instructions, the present petition is disposed of directing the respondent to conclude the proceedings expeditiously and in accordance with law. In case, the petitioner is found to be under illegal occupation, the suitable proceedings initiated against him shall also be concluded expeditiously.
