Shri Saket Kumar Gupta, learned counsel for the cross objector submits that the objector has filed an application under Order-9, Rule-13 of C.P.C. before the motor accident claims tribunal as the impugned judgment and award is ex-parte but on account of pendency of this cross objection and the lower court record is before this Court, the application under Order-9, Rule-13 is not being disposed of, therefore he does not want to press this objection and it may be dismissed as not pressed with liberty to pursue his aforesaid application. He further prayed that the lower court record be sent back to the concerned court. Shri Anil Srivastava, learned counsel for the respondents submits that he has already filed objection to the effect that this objection is not maintainable as all the parties before the claims tribunal have not been impleaded. However, he has no objection to the withdrawal of the cross objection. Shri Amitesh Mishra, Advocate holding brief of Shri Shobhit Nigam, learned counsel for the respondent has also no objection to the withdrawal of the cross objection.
