Neutral Citation No. - 2025:AHC-LKO:15150-DB Court No. - 2 Case :- WRIT - C No. - 2239 of 2025 Petitioner :- Durga Prasad Maurya Respondent :- State Of U.P. Thru. Acs/ Prin. Secy. Deptt. Of Home Lko And 4 Others Counsel for Petitioner :- Ashutosh Kumar Singh Counsel for Respondent :- C.S.C.,Patanjali Chaturvedi Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard Sri Ashutosh Kumar Singh, learned counsel for the petitioner, Sri Patanjali Chaturvedi, learned counsel for the opposite party No.4 and learned Standing Counsel for the State. Learned counsel for the petitioner has filed a supplementary affidavit today in the Court, which is taken on record. The petitioner alleges encroachment on his land by the Nagar Nigam and the police officials. It is informed that Writ Petition No.11543(M/S) of 2016 is pending having been filed by one Shivpata, wherein the instant petitioner is opposite party and also there is a status quo order. If the subject matter of the dispute is involved in the aforesaid Writ Petition then the petitioner may join issue there or seek other remedies as may be permissible in law i.e. civil, criminal or revenue law as the case may be, but, we cannot enter into such private dispute under Article 226 of the Constitution of India, specially as learned counsel for the Nagar Nigam says that Nagar Nigam has not given any permission for construction. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 12.3.2025 Saurabh Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
