1. Heard the learned counsel for the petitioner.
2. The learned counsel for the petitioner submits that the petitionerwas arraigned as accused in Crime No.297of 2024 of Kanigiri Police Station, Prakasam District, registered for the alleged offences under Sections 420, 406 and 506 of the Indian Penal Code, 1860.
3. It is alleged in the complaint that the petitioner, being the employee of the 2nd respondent, had collected money from the retailers and cheated the 2nd respondent. The learned counsel submits that the offences alleged against the petitioners are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Kanigiri Police Station, Prakasam District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023,insofar as the petitioner are concerned, for

the purpose of investigation in connection with Crime No.297 of
2024.
5. Accordingly, the criminal petition is disposed off.
