Neutral Citation No. - 2025:AHC-LKO:4620 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 240 of 2025 Petitioner :- Phoolchand And Others Respondent :- Consolidation Officer, Gonda And Others Counsel for Petitioner :- Anoop Kumar Upadhyay Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. In pursuance of the order dated 21.1.2025 passed by this court, a report has been submitted by the Stamp Reporting Section. Considering the same, this Court finds that the ofÏcers of the stamp reporting section are apparently not aware or are non conversant with the manner in which the court fee is to be determined. Even in the explanation which was furnished, it has been mentioned that there is a dilemma in deciding the court fee in matters to be such as the case at hands. It is quite surprising where the High Court has a stamp report section and the primary duty of the ofÏcials posted in the said section is to determine the court fee and ensure that proper court fee is paid, yet the dilemma in their minds while dealing with these cases to determine the court fee, is apparently not appreciable. This court direct Senior Registrar of this Court of this Court to ensure that the proper assistance/ training is given to the ofÏcials posted at Stamp Reporting Section so that they can ensure that that appropriate court fee is paid. This is being done in other cases, this Court has noticed that irresponsible stamp reporting reports have been placed on record. Shri Anoop Kumar Upadhyaya, learned counsel for the petitioners submits that he may be permitted to withdraw tis petition as the parties who were parties in the court concerned of which expedition is sought, have not been impleaded. Considering the aforesaid, the petition is
dismissed as withdrawn with liberty to the petitioners to file afresh, with appropriate pleadings/ impleading proper parties annexing the necessary order-sheets in respect of the proceedings of which he seeks expedition. Let this order be pleased and brought to the notice of learned Senior Registrar of this Court, for its compliance.
