The present petition has been filed for the following relief: "(i) To issue a writ of Mandamus commanding the Opposite Parties No.1 to 4 to take the necessary and prompt action for eviction and removal of the illegal encroachment of the opposite party no.6 made over the Public Utility Land i.e. Khasra/Gata No.517 (area 0.7400 hectare) recorded as recorded as Bheeta in the name of Gaon Sabha situated in village Sarsawan, Pargana Aldemau, Tehsil Kadipur, District Sultanpur in compliance of the order dated 27.10.2023 passed by the Tehsildar (Judicial)/Assistant Collector, Tehsil Kadipur, District Sultanpur in Case No.1949/2022 (Computerized Case No.T202204680401949 (Gaon Sabha Versus Mohd. Rais) under section 67 of Uttar Pradesh Revenue Code, 2006, as contained in Annexure No.1&2 respectively to this writ petition." 3. Learned Standing Counsel, based upon the instructions, states that against an order, a recall application has been filed, which is pending for consideration. 4. In view of the said instructions, the present petition is disposed of commanding the respondent to take final decision with all expedition, in accordance with law.
