(2) According to the petitioner, he has applied for sanction of a house plan, however no decision has been taken on his application. By means of this writ petition, petitioner has sought the following relief: “(I) Issue a writ, order or direction in the nature of mandamus commanding the Respondent Authority to take a decision on the Petitioner’s Online Application bearing File No. HRDA/NC/0251/23-24 dated 05.12.2023 for grant of building construction permission on his property situated at Village Malakpur, under Nagar Nigam Sector Roorkee, District Haridwar, for Non- Residential Commercial site purpose, within a time frame to be fixed by this Hon’ble Court.” (3) Learned Counsel appearing for Haridwar-Roorkee Development Authority submits that the land over which petitioner proposes to raise construction is public land belonging to State Government. He further submits that a civil suit was filed by the petitioner seeking declaration of his rights, which was decreed in his favour, however second appeal, filed by Nagar Nigam, Roorkee, is pending consideration before this Court. (4) Be that as it may, since petitioner’s application, made on 5.12.2023, is still 2025:UHC:9093 pending consideration, therefore, writ petition is disposed of with a direction to Secretary, Haridwar Roorkee Development Authority to consider petitioner’s application and pass appropriate order, as per law, within ten weeks from the date of production of certified copy of this order.
