Neutral Citation No. - 2025:AHC-LKO:5098-DB Court No. - 1 Case :- WRIT - C No. - 733 of 2025 Petitioner :- Gazala Parveen Respondent :- State Of U.P. Thru. Secy. Home Lko. And 7 Others Counsel for Petitioner :- Gauri Shankar Maurya Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard learned counsel for the petitioner and learned Standing Counsel for the State.
2. The relief prayed for in the present writ petition reads as under:-
1. Issue a writ, order or direction in the nature of mandamus commanding the respondents to restore back the physical and legal possession in ante status quo possession since the date of sale deed dated 04.01.2018 and dispossessed the private respondents from the land in question of Arazi No.183 forthwith by passing appropriate order in writing in regard to dispossess/delivery of possession of the petitioner in accordance with law.
2. To issue any other writ, order or direction, which this Hon’ble Court may deem fit and proper in the circumstances of the case, may be passed in favour of the petitioner and against the respondents.
3. It appears from the relief clause itself that the petitioner has been dispossessed from the land allegedly belonging to him way back in the year
2018.
4. The dispute essentially being of the civil nature between the two private parties cannot be taken cognizance of in exercise of writ jurisdiction.
5. Thus, leaving it open for the petitioner to avail the appropriate remedy available to her under law, the writ petition is dismissed. (Subhash Vidyarthi,J.) (Attau Rahman Masoodi,J.)
