As of now, the petitioner is not recorded in respect of Gata No. 50 but he says that some proceedings have been initiated by him for recall of an order passed under Section 229-B of the U.P.Z.A.& L.R. Act, 1950. That by itself will not give any right to the petitioner to approach this Court alleging that an overhead tank is sought to be constructed on the aforesaid gata specially as opposite party says that as of now the land is recorded as Naveen Parti. Construction of overhead tank will remain subject to any order being passed in the proceedings initiated by the petitioner and if ultimately his right and interest in the said proceedings is declared and he is recorded in respect thereof then, he can avail remedial measures.
