The claim of petitioner is duly satisfied on basis of averments on basis of averments made in counter affidavit which has been served upon the counsel for petitioner and the same will be filed during the course of day in Registry. Learned counsel for petitioner submits that though the claim has been accepted, however, instead of giving Rs. 8,53,710.07/- completely only Rs. 5,28,607/- lac has been given to the petitioner. Learned counsel for respondent refers paragraph Nos.11 and 12 of counter affidavit that there are certain financial constrained and payment can be paid in installment at this stage. An order dated 03.10.2024 passed in Writ- A No.14748 of 2023 is placed on record, where in similar circumstances a direction was passed to pay Rs.75,000/- per month towards post retiral dues. In the aforesaid circumstances, since there is a financial constrained which has already been noted in above referred order dated 03.10.2024, therefore, this writ petition is disposed of with an observation that concerned respondent will clear the outstanding amount as soon as possible and meanwhile, they will try to follow the direction given in referred order dated 03.10.2024.
