Of Excise Lko And 5 Others Counsel for Petitioner :- Anoop Kumar,Pankaj Bala,Sandeep Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J. 1. Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this writ petition, the petitioner has inter alia prayed for issuance of a writ of mandamus commanding the respondents to decide the representation dated 12.11.2024 as contained in annexure no.1 to the writ petition. 3. The representation appears to have been made before the District Excise Officer, Hardoi who according to learned counsel for the opposite parties may not be the competent authority to consider and decide such a representation. It is pointed out that the authority for taking decision on such a representation is vested in the Excise Commissioner, Prayagraj i.e. respondent no.2. 4. In these circumstances we leave it open for the petitioner to make a fresh representation before the opposite party no.2. In case any such representation is made, the same shall be decided within a period of ten days from today by passing a reasoned and speaking order expeditiously and preferably within a period of one month from the date of making the representation. 5. The writ petition is accordingly disposed of. (Subhash Vidyarthi,J.) (Attau Rahman Masoodi,J.)
