This is defendant's petition. In the suit instituted by plaintiff- respondent no. 1, an application for grant of temporary injunction was moved in which ad interim injunction was granted by trial court. Against the said order, a misc. appeal was preferred by petitioner which has been rejected by order impugned dated 04.02.2019. 2. Learned counsel for the petitioner submits that already objection has been preferred against grant of ad interim injunction and the court below has not decided the temporary injunction application till date. 3. It is well settled that against ad interim injunction, no appeal shall lie. In view of the said fact, no interference is required in the order impugned. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon court below to proceed with temporary injunction application and decide the same, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
