Heard learned A.G.A. for the State and Sri R.D. Shahi, learned counsel for the contemnor. 2. Though a detailed reply is filed by the contemnor Sri Rajesh Shukla, Advocate, through Sri R.D. Shahi, Advocate, however, at the very outset, both contemnor and his counsel Sri R.D. Shahi state that even if inadvertently some rash words were uttered, the contemnor submits his unconditional apology with regard to the same. The said apology is also made in Para-19 of affidavit dated 8.12.2024 filed by the contemnor. It is further submitted that this is the only incident which has ever occurred in the Court and other than that, there is no other contempt application or criminal case pending against the contemnor. Sri Shahi further submits that the complaint lodged by the contemnor is also with regard to misappropriation of his shares by the company. 3. Looking into the aforesaid facts and circumstances of the case and also looking into the nature of allegations, without going into the merits of the case, we caution the contemnor to be careful while conducting himself in Court and restrain himself from using harsh words against the Presiding Officer in future. In case any further contempt application is ever filed against the contemnor, he shall produce a copy of this order before the Court concerned along with his reply. 4. With the aforesaid caution note, present contempt proceedings are dropped/closed. 5. Accordingly, the contempt application is disposed of. .
