2. This is an application under Section 482 of the BNSS, 2023 praying for pre-arrest bail in respect of Rangia P.S. Case No.182/2024.
3. The informant has alleged in the FIR that her husband was a drug addict and about a year before lodging of the FIR, her husband along with some other persons had led Sashastra Seema Bal (SSB) officials to apprehend another drug dealer. A few days prior to lodging of the FIR, the said apprehended drug dealer met the husband of the informant. The husband was taken away in an auto rickshaw. Thereafter, the dead body of the husband of the informant was recovered.
4. The Case Diary reveals that there are some materials against the present applicant. It is also mentioned in the Case Diary that the deceased died after sustaining some injuries. Apart from that, there are no sufficient materials to justify the detention of the present applicant. Therefore, his pre-arrest bail application is allowed.
5. It is hereby directed that in the event of arrest in connection with Rangia P.S. Case No.182/2024, the applicant Raju Kalita shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority.
6. The petitioner shall co-operate with Police Investigating Officer as and when called for. With the aforesaid direction, the present application is disposed of. Case Diary shall be returned.
