JUSTICE SOUMITRA SAIKIA ORDER 08.05 .2025 Heard Mr. H. Talukdar, learned counsel for the applicant. By way of this application the applicant seeks appropriate orders from the Court for arraying the opposite party Nos. 1 and 2 as respondent Nos. 2 and 3 in the Cont.Cas(C) No. 576/2023. It is submitted that the opposite parties are also equally responsible for non-compliance of the direction contained in the order dated 20.02.2023 passed in WP(C) No. 5484/2020. It is further submitted that since the directions have not yet been complied with, the opposite parties are also equally responsible for non-compliance of the directions and they are also required to be arrayed as respondents in Cont.Cas(C) No. 576/2023. Mr. A. Chaliha, learned counsel appears for the respondent No.1 does not object to the prayer made. Accordingly, having considered the submissions made and upon careful perusal of the pleadings available on record, the Interlocutory Application stands allowed the opposite party No. 1 namely Mr. Alok Kumar, IAS, The Chief Electoral Officer, Assam, Dispur, Guwahati-06 and opposite party No.2 Shri Navadeep Pathak, ACS, The District Commissioner, Bongaigaon, Dist- Bongaigaon, Assam, Pin- 783380 are arrayed as respondent Nos. 2 and 3 in the Cont.Cas(C) No. 576/2023. The Interlocutory Application stands allowed without issuing notice as the opposite parties shall get sufficient opportunities to file their necessary affidavits Page No.# 3/3 and make necessary submissions before the Court. Interlocutory Application is hereby disposed of. The petitioner will file necessary amended cause title within a period of one week from today. JUDGE Comparing Assistant
