Hon'ble Manish Mathur,J. 1.Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. 2. Petition has been filed challenging orders dated 23.10.2019 and 28.08.2021 whereby petitioner's initial appointment on a Class III post on compassionate basis in terms of the relevant Dying in Harness Rules has been cancelled. 3. Learned counsel for petitioner has adverted to paragraph 3 of the rejoinder affidavit to submit that he was not qualified for appointment on a Class III post and that fresh orders may be passed for the post on which he is qualified since the primary intention is to support family members of deceased. 4. In terms thereof, it has been submitted that petitioner is ready and willing for consideration for compassionate appointment on any Class IV post. 5. Learned State counsel does not have any objection in case petitioner's representation for such a prayer is considered. 6. In view thereof, without interfering with the impugned orders, liberty is granted to petitioner to make a fresh representation before opposite party No.3 i.e. Commanding Officer, 20 U.P. Girls Battalion, NCC,498.206/10, Faizabad Road, Lucknow for compassionate appointment on any Class IV post. Such a representation made shall be considered and decided expeditiously within a period of four weeks from the date a certified copy of this order is produced before the said authority. 7.
