At the time of his death, he was posted as Coordinator, Cluster Resource Centre, Sebila, Block Munsiyari, District Pithoragarh. In view of the acute financial crisis, which befell upon the family, petitioner applied for compassionate appointment in the year 2018 and reminders were also sent in 2021 and 2022, but no decision has been taken on petitioner’s request. By means of this writ petition, petitioner has sought a direction to consider his claim for compassionate appointment under the Dying in Harness Rules, 1974. (3) Learned State Counsel submits that decision on petitioner’s application, if already not taken, shall be taken within four weeks. (4) Writ petition is, accordingly, disposed of with a direction to District Education Officer (Elementary) to take decision on petitioner’s application, as per law, within four weeks from the date of presentation of certified copy of this order.
