Mr. Bhuwan Bhatt, learned counsel for the respondent-Nagar Palika Parishad, Mussoorie. 4. Petitioners have filed the instant Writ Petition praying for the following reliefs:- (i) Issue a Writ, Order or direction in the nature of certiorari quashing the impugned order dated 09.09.2025 (contained as annexure no. 5 to this writ petition) issued by the Executive Officer Nagar Palika Parishad, Mussoorrie, Dehradun. (ii) Issue a Writ, Order or direction in the nature of mandamus commanding the respondents to pay the Petitioners minimum of pay scale Rs. (5200- 20200) with grade pay Rs. 1900 to the petitioners as being paid to the regular employee working on the class III post on the principle of equal pay for equal work. (iii) Issue writ rule or direction in the nature of mandamus commanding and directing to the respondents to regularize the services of the petitioners on Class III post in the respondent department. 5. Learned counsel for the petitioners contends that the petitioners were engaged as Driver on contract basis and have served for more than 12 years however, neither they are being paid 2025:UHC:8794 minimum pay scale (5200-20200) Grade Pay 1900 nor their services are being regularised. 6. Learned counsel for the petitioners submits that earlier the petitioners had filed a Writ Petition No. 1408 (S/S) of 2025, which was decided on 28.08.2025 and in purported compliance of the order passed in the aforesaid Writ Petition, the Executive Officer, Nagar Palika Parishad, Mussoorie had passed the impugned order on 09.09.2025, by which, he has denied to pay minimum pay scale to the petitioners. 7. Learned counsel submits that the impugned order is a cryptic order and in the order no reason has been assigned for denial of benefit of minimum of pay scale to the petitioners, though in the impugned order respondent admitted that in pursuance to the order passed in Writ Petition No. 786 (S/S) of 2018 and the Writ Petition No. 490 (S/S) of 2022 minimum pay scale is being paid to the other employees of Nagar Palika Parishad Muni ki Reti and Nagar Palika Parishad Doiwala, Dehradun. 8. Learned counsel for the petitioners submits that in a similar Writ Petition No. 1593 (S/S) of 2025 the decision dated 09.09.2025 was put to challenge and the aforesaid writ petition was decided on 25.09.2025 and the present Writ Petition is liable to be decided in terms of the aforesaid order. 9. Learned counsel for the respondents stated that they have no objection to the prayer made by the petitioners. 2025:UHC:8794 10. Submissions of learned counsel for the parties are placed on record. 11. Present Writ Petition is decided in terms of the order dated 25.09.2025 passed in Writ Petition No. 1593 (S/S) of 2025. The Executive Officer, Nagar Palika Parishad, Mussoorie shall reconsider the representation of the petitioners in terms of the order dated 29.03.2022 passed in Writ Petition No. 490 (S/S) of 2022 without being influenced by the impugned order dated 09.09.2025, within a period of four weeks from the date of production of certified copy of this Order. Till the decision on the petitioner’s representation, they shall be paid minimum of pay scale payable for the post held by them. 12.
