The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.260 of 2022, “State vs. Navi Ahmad and Others” pending before the court of Judicial Magistrate/ Civil Judge (Junior Division), Sitarganj, District Udham Singh Nagar under Sections 323, 498A, 504 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 2. Mr. Faizan Ali, learned counsel for the applicants - accused. 3. Mr. Pratiroop Pandey, learned Assistant 1 2025:UHC:9028 Government Advocate for the respondent no.1. 4. Mr. Mohd. Safdar, learned counsel for the respondent no.2 - informant and the wife of the applicant no.3. 5. All the applicants are present in-person. They are identified by Mr. Faizan Ali, Advocate. 6. The respondent no.2 is present in-person. She is identified by Mr. Mohd. Safdar, Advocate. 7. Applicant no.1 is the father, applicant no.2 is the mother, applicant no.4 and applicant no.5 are the sisters and applicant no.6 and applicant no.7 are the brothers of the applicant no.3. 8. Both, the respondent no.2 and the applicant no.3 submitted that there were matrimonial disputes between them. They have resolved their disputes. A Compounding Application (IA No.1 of 2025) and affidavits are filed. Applicants and the respondent no.2 submitted that they have filed affidavits with their free will and without any pressure. 9. The respondent no.2 has requested to quash the entire proceedings of the Criminal Case No.260 of 2022. 10. The said request of the respondent no.2 has not been opposed by the respondent no.1. 2 2025:UHC:9028 11. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.260 of 2022, “State vs. Navi Ahmad and Others” pending before the court of Judicial Magistrate/ Civil Judge (Junior Division), Sitarganj, District Udham Singh Nagar, are quashed. 12. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.260 of 2022, “State vs. Navi Ahmad and Others” pending before the court of Judicial Magistrate/ Civil Judge (Junior Division), Sitarganj, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 10.10.2025 ALOK KUMAR VERMA, J.
