ORDER: This Writ Petition is filed declaring the action of the respondents in not releasing the amount of Rs.8,03,463-79/- to the petitioner in respect of execution of work by the petitioner i.e., providing of CC road under the program of ‘Gadapa Gadapaku Mana Prabhutvam’ vide Agreement No.71- 2023-24/El, dated 23.02.2024 within the limits of Pedana Municipality, Krishna District during the year 2024 as arbitrary and illegal. Heard learned counsel for both the parties.

3. submitted that the petitioner had executed the work as specified in the 'i agreement referred above and the concerned officers had verified the same at ] various levels and recorded the work in M-Book No.01/2023-24. However, the amount due to the petitioner was not paid by the respondent authorities. Smt Sireesha Rani Vallabhaneni, learned standing counsel for
4. respondent No.2, on instructions signed by the Commissioner, Pedana Municipality, submits that the work executed by the petitioner was completed in all aspects and the bill arrived was Rs.8,03,463.79/-. As there was no budget allocation under the Gadapa Gadapaku Mana Prabhutvam (GGMP) Grant, the amount due to the petitioner could not be paid. She further submits that as soon as the Government allotted budget and released the funds for the
4 works under GGMP, the bills of the petitioner would be uploaded in CFMS portal for onward submission to the Pay & Accounts Officer, Vijayawada so as to credit the work bill amount to the petitioner.

As there is no dispute to the execution of works and amount due to the Petitioner, the Writ Petition is disposed of, at the stage of admission, with the consent of both sides and placing the written instructions on record, with the following direction; (i) The Respondent authorities are directed to pay the amount due to the Petitioner within a period of four (4) months from today. (ii) There shall be no order as to costs. As a sequel, the miscellaneous petitions if any shall stand dismissed.
