Deka, learned counsel for the petitioner, who submits that the order dated 10.05.2023 passed in WP(C) No.2340/2023 had directed the respondent No.3 to examine and take a decision on the petitioner’s representation dated 08.04.2023, within 1(one) month, in relation to the E- Auction notice dated 06.12.2022, wherein the petitioner’s bid amount was found to be the highest in respect of the auction held for the sale of immovable properties of the Fatemabad Tea Garden. Though the petitioner’s bid was the highest, the petitioner’s bid was cancelled, vide order dated 04.04.2023. The petitioner thereafter submitted the representation dated 10.05.2023, praying to recall the order dated 04.04.2023. 2. The petitioner’s counsel submits that a contempt case was not filed for noncompliance of the order dated 10.05.2023 passed in WP(C) No.2340/2023, as the same was barred by limitation under Section 20 of the Contempt of Courts Act. He accordingly submits that a similar direction may be issued to the respondent authorities to decide the petitioner’s representation. Page No.# 3/3 3. Mr. P. Nayak, learned counsel submits that he has got no objection to the prayer made by the petitioner’s counsel. 4. In view of the consent of the parties, the respondent No.3 is directed to take a decision on the petitioner’s representation dated 08.04.2023, within a period of 3(three) weeks from the date of receipt of a copy of this order. The decision taken by the respondent No.3 shall be furnished by Mr. P. Nayak, learned counsel for the respondents to Mr. P. Deka, learned counsel for the petitioner. 5.
