By way of filing this petition, a prayer has been made by the petitioner for issuing directions to the respondents to consider his case for promotion to the post of Head Constable. It has been further pleaded in the writ petition that the promotion has been granted to the respondent No.4 erroneously, therefore, his promotion order be cancelled. 2. At the outset, this fact has been brought into the notice of the Court that the petitioner has secured 20.75 marks while the respondent No.4 has secured 35 marks, therefore, (2 of 2) [CW-3469/2009] on the basis of the marks and merit of the respondent No.4, his case was considered for promotion to the post of Head Constable from the post of Constable. 3. Since, the petitioner has secured less marks, therefore, his case was not considered for promotion. This Court finds no merit and substance in this writ petition. 4. Accordingly, the instant writ petition is dismissed. Pending applications, if any, also stand dismissed. (ANOOP KUMAR DHAND),J KuD/97
