2025:JHHC:17265 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3420 of 2025 ----- Hemant Pal, S/o Bhuneshwar Pal, R/o Village Belboriya, Kaliyam, P.O. Gohaldangara, P.S. Chakulia, Dist East Singhbhum .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Shish Alam, Advocate For the State : Mr. Pankaj Kumar, P.P. …...... 09/ 01.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 316(2), 316(5), 318(3), 318(4), 61(2)(a) of B.N.S. 3. The allegation against the petitioner is that he had collected the installments for different loans, but he did not deposit the amount and thus, has defalcated Rs.3,74,500/- thereby cheating the members. 4. Learned counsel for the petitioner submits that entire amount has been deposited in the account of the respective holders and refers to Annexure-2. 5. The learned APP opposes the prayer for anticipatory bail. 6. After going through the Annexure-2, I find that the same is some notings and accounts maintained in white paper, whose authenticity is yet to be proved. Further, there is nothing to suggest that the amount has been deposited rather the allegation is that the petitioner has defalcated the entire amount after collecting the same from the members. 7. Considering the nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioner. 8. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Ghatshila P.S. Case No.03 of 2025, pending in the Court of learned Additional Chief Judicial Magistrate, Ghatsila, stands rejected. (ANANDA SEN, J.) R.S./
