Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner with the following prayers: "(1) to issue appropriate writ, order or direction in the nature of mandamus commanding the O.P. No. 1 to 5 to allot the fair price shop of village panchayat sembhuai, Block and Tehsil Gauriganj District Amethi in strictly accordance to G.O dated 05-08-2019 given benefit of 5% quota to ex-army personnel. (ii) to issue appropriate writ, order or direction in the nature of mandamus commanding the O.P. No. 1 to 5 to direct the Sub-Divisional Magistrate (O.P. No.2) to decide the petitioner representation dt. 27-12-2024 pending before him." 3. Learned Standing Counsel based upon the instructions states that the shop in question has already been allotted. 4. In view of the subsequent development, the present petition is dismissed as withdrawn with a liberty to the petitioner to file a fresh petition and to take such steps as may be advised against the subsequent decision taken by the respondent.
