2025:JHHC:12553 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2550 of 2025 ----- 1.Ekram Ansari @ Akarmula Ansari 2.Istiyak Ansari 3.Imtiyaz Ansari All are S/o Samser Ansari, R/o Village Madanpur, P.O. Kokdora, P.S. Pithoria, District Ranchi .... Petitioner(s). Versus The State of Jharkhand … Respondent(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Dilip Kr. Chakraverty, Advocate For the State : Mr. Shashi Kumar Verma, A.P.P. …...... 03/ 28.04.2025: Heard, learned counsel for the petitioners and learned counsel for State. This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 191(2), 191(3), 126(2), 115(2), 109,74 of the Bhartiya Nyay Sanhita, 2023. Learned counsel for the State opposes the prayer for anticipatory bail of the petitioners. Learned counsel for the petitioners submits that there is no injury report and without seeing the injury report, the Court concerned has rejected the anticipatory bail. He submits that infact there is no injury on the side of any of the accused. He further submits that there is a case and counter case as there was free fight between the parties and the case filed by the accused persons is prior in time. From the arguments and also from the F.I.R. and document, I find that there was free fight between two groups. The parties were armed with rod, sword, knife etc. and assault each other. Considering the nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioners, who have also participated in the occurrence. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Pithoria P.S. Case No.20 of 2025, pending in the Court of learned Court of Judicial Magistrate, 1st Class at Ranchi, stands rejected. R.S./ (ANANDA SEN, J.)
