DATE PC : The present writ appeal under Clause 15 of the Letters Patent has been preferred against judgment and order dated 13.02.2025, passed in W.P.No.19608 of 2018 and batch. The learned single Judge, by virtue of judgment and order impugned had dismissed the writ petition on the ground that material facts had been suppressed by the petitioner - appellant herein while preferring the writ petition and also suppressed the fact regarding pendency of the civil disputes between the petitioner and the private respondent Nos.3 and 4, namely Mr. P. 2. Sivamohan Reddy and Ms. P. Kamalini. / 2 HCJ & RCJ WA 294 2025 3. We have heard learned counsel for the parties at length. In our opinion, the issue can be resolved by relegating the parties to 4. respondent No.2 Assistant Divisional Engineer, APSPDCL, North Rajupalem, who issued the show cause notice, dated 08.05.2018, to which the appellant has also filed an appropriate response. The said authority shall pass an appropriate speaking order after affording both the appellant as also the private respondent Nos.3 and 4, namely Mr. P. Sivamohan Reddy and Ms. P. Kamalini, an opportunity of being heard. Appropriate orders be passed within three weeks, positively, uninfluenced by the observations made by the learned single Judge. Once the order is passed, it shall be open to parties to avail the remedies in accordance with law. Until such time that respondent No.2 takes an appropriate decision, no coercive steps be taken against the appellant herein. Be that as it may, the judgment and order impugned to that extent shall 5. stand modified. Accordingly, the present writ appeal is disposed of. No order as to costs.
