This first anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No.561/2024 registered at Police Station GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.03.10 11:19:20 +0530 2 Civil Lines, District Raipur (C.G.) for the offence punishable under Section 420/34 of the IPC. 2. Case of the prosecution, in brief, is that the complainant Rajendra Prasad Sharma made a complaint before the Police Station Civil Lines Raipur alleging that Prashant Pandey, Vipin Motwani resident of Amlidih Raipur who runs a shoe shop, Manish Asrani and Golu Ranglani resident of Mahavir Nagar Amlidih they talked about providing jobs for unemployed people. When the complainant told them about getting a job for his son Ninish Dev Sharma who had filled the form for recruitment to the post of Engineer in CG State Electricity Board, they took Rs. 16,40,000 in different installments and took Rs.1,50,000 from his daughter-in- law Yogita's State Bank of India account to Prashant Pandey's account through Prashant Pandey's Central Bank Telibandha. He has stated that these people did not provide his son a job and deliberately cheated him by taking a total amount of Rs. 17,90,000 in the name of providing a job. 3. Learned counsel for the applicant would submit that applicant alongwith two co-accused persons Prashant Pandey & Vipin Motwani are said to have been involved in the present case and from the said two co-accused the money which was paid in their account have compromised with the complainant of the case as they have returned the said amount, the said fact has been mentioned in para 6.5 and so far as the applicant is concerned, no 3 money was transferred in his account nor was recovered from him. He would submit that there are six previous cases registered against the applicant and in five cases he has been acquitted. Hence he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel has opposed the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, nature of dispute and material available in case diary, without further commenting anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Manish Asrani, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) He shall appear before the trial Court on each and every date given to him by the said Court till 4 disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
