1. Heard Ms. S. Goswami, learned counsel for the petitioner. Also heard Mr. N. Goswami, learned State counsel representing the respondent Nos. 2 and 3 and Ms. P. Mahanta, learned Standing Counsel for the Revenue Department representing the respondent No. 1.
2. The petitioner has approached this Court with a grievance that he had filed a revenue appeal before the respondent No. 2, which was registered as KRC(M)/380/2022, KRC(M) 509/2023, has not yet been disposed of.
3. In the aforesaid backdrop and taking note of the limited issue, this Court asked Mr. N. Goswami, learned State counsel to obtain instruction as to whether the said revenue appeal is pending as on date or has already been disposed of.
4. On instruction, Mr. Goswami, learned State counsel submits that the appeal is pending, however, could not be heard as the respondents in the said appeal has continuously being absent on the dates fixed for hearing.
5. In the considered opinion of this Court, absence of the respondents cannot be in all circumstances a ground for keeping an appeal pending.
6. In view of the aforesaid, this writ petition stands disposed of with a direction to the respondent No. 2 to decide the aforesaid appeal (KRC(M)/380/2022, KRC(M) 509/2023) within a period of 30 days from the date of receipt of the certified copy of this order to be furnished by the petitioner before the
