JUSTICE DEVASHIS BARUAH ORDER 05.05.2025 It is seen from the records that vide an order dated 19.07.2024, this Court made it very Page No.# 2/2 clear that as the appeal has been pending since 2009, and the appellant was directed to publish the notice upon the respondent Nos. 1 and 2, in local newspaper and the steps were required to be taken in the month of September, 2024, It was also observed that if the appellant failed to take steps for service of notice upon the respondent Nos. 1 and 2, appropriate orders would be passed. When the matter was again listed on 21.10.2024, such steps were not taken, as directed by this Court vide order dated 19.07.2024. The matter has come after 6 months, thereafter. Then also, the appellant has not taken the steps. 2. From the above, it appears that the appellant is not interested in pursuing the instant appeal, inasmuch, as in an appeal pending since 2009, no steps have been taken upon the plaintiff, who is the respondent No. 1. 3. Considering the above, the instant appeal stands dismissed, for want of steps. 4. Send back the LCR (if any), after 90 days. JUDGE Comparing Assistant
