Neutral Citation No. - 2025:AHC-LKO:2993-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 37 of 2025 Petitioner :- Surat Singh Respondent :- State of U.P. Thru. Prin. Secy. Revenue U.P. Lko. and 6 others Counsel for Petitioner :- Prabhakar Pandey, Abhishek Shukla, Neetu Verma Counsel for Respondent :- C.S.C., Pratul Kumar Srivastava (S.C.), Namit Sharma, Ratnesh Chandra Hon'ble Arun Bhansali,Chief Justice Hon'ble Manoj Kumar Gupta,J. 1. This petition, purportedly in public interest, has been filed by the petitioner seeking to allege encroachment over park of railway colony situated at Balaganj, Tehsil Sadar, District Lucknow. 2. Submissions, inter alia, have been made that respondent No. 7 has encroached over the park and despite the representations made by the petitioner, the encroachments have not been removed. 3. A perusal of the petition indicates that petitioner, as a resident of the colony, has alleged encroachment near Patel Adarsh Inter College and allegations have also been made that a sale deed has got executed by respondent No. 7. In grounds of the petition, petitioner has disclosed that he is incharge of Patel Adarsh Inter College. A perusal of the map produced with the petition indicates that the College, inter alia, is being operated where the layout plan pertains to the staff colony and apparently, on account of the some dispute with respondent No. 7, the petition has been filed. 4. It is strange enough that the notice has been sent on 14.12.2024 by registered post and the petition has been filed within three weeks on 07.01.2025 alleging inaction on part of the development authority. 5. Looking to the nature of the allegations made, non-disclosure of the credentials appropriately and apparent lack of bona fide, we do not find any reason to entertain the present public interest litigation, the same is, therefore, dismissed.
