Neutral Citation No. - 2025:AHC-LKO:3545 Court No. - 16 Case :- CRIMINAL REVISION No. - 64 of 2025 Revisionist :- Jitendra Kanaujiya Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko And Another Counsel for Revisionist :- Ram Milan Yadav Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the revisionist and learned A.G.A. for the respondent State. Notice to respondent no.2 is dispensed with in view of the proposed
order. Perused the record. Perusal of the record shows that it is not in dispute that respondent no.2 is a legally wedded wife of the revisionist. She is residing away from the revisionist with sufficient cause. She has been subjected to cruelty both mental and physical for demand of dowry. She is destitute and unable to maintain herself. On the contrary, the revisionist has adequate source of income. He is working in Kuwait. Although it has been stated by learned counsel for the revisionist that his father has ousted from his property, however, the revisionist has not filed any affidavit regarding his source of income. Learned trial court after examining these issues has rightly concluded and awarded a meager amount i.e. sum of Rs.4,000/- per month to be paid to the respondent no.2 by the revisionist from the date of filing of the application.
Learned counsel for the revisionist, upon query being made by this Court, fairly submitted that he has not paid single penny to respondent
no.2 till date. On due consideration to the submissions advanced and perusal of the judgement as well as record, I find no illegality in the order impugned. The revision, being devoid of merit, is accordingly dismissed.
