Neutral Citation No. - 2025:AHC-LKO:2723-DB Court No. - 1 Case :- WRIT - A No. - 470 of 2025 Petitioner :- State Of U.P. Thru. Prin. Secy. /Addl. Chief Secy. Public Works Deptt. Lko. Respondent :- Rajendra Kumar Sonwani And Another Counsel for Petitioner :- C.S.C. Counsel for Respondent :- Shireesh Kumar,Manish Mishra Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard the learned Standing Counsel appearing on behalf of the State, Sri Shireesh Kumar, the learned counsel for the opposite party no.1 and perused the records.
2. The opposite party no.1 feeling aggrieved against the order passed by the competent authority for reduction of 2% of his monthly pension permanently, approached the learned Tribunal against an order dated 06.01.2022, which on consideration of the rival contentions before the learned Tribunal in the light of the pleadings, has been set aside.
3. The allegations levelled against the petitioner are not such as would have caused a loss to the State Government, rather the savings from a particular work performed by the opposite party no.1, though duly accounted for, were utilized against some ancillary works.
4. As there was no allegation of financial loss and the learned Tribunal has recorded its findings on appreciation of facts, this court has no reason to take a different view on the issue and the
judgment/order passed by the learned Tribunal in claim petition as well as in the review application in these circumstances does not call for any interference of this Court in exercise of its
extraordinary writ jurisdiction.
5. Thus, the petition being bereft of any merit is accordingly dismissed. . [Subhash Vidyarthi, J.] [A.R. Masoodi, J.]
