JAMMU AND KASHMIR BANK LIMITED THROUGH ITS CHAIRMAN ...Respondent(s) Through: Mr. R.A Jan, Sr. Advocate with Ms. Nasheem, Advocate Mr. Naseer Ul Akbar, Advocate CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDER 23.12.2025 CM(8251/2025) 1. This is an application by one Kulsum Mir seeking impleadment as Co-petitioner/party petitioner in the writ petition bearing WP(C) No. 1530/2024. 2. The impleadment is sought on the ground that during the pendency of this petition, the petitioners, the Bank and the applicant have entered into tripartite agreement dated 23.07.2024, which is appended with the application, and, therefore, the applicant has stake in the litigation, 3. Today learned counsel for the petitioners has passed on a communication of the Bank dated 18.12.2025, addressed to the petitioners, wherein the terms and conditions of settlement had been enumerated. He submits that since the petitioners have settled the matter with the Bank, and, therefore, he has instruction not to press the writ petition. Communication is taken on record. 4. Mr. R.A. Jan, learned Senior counsel appearing for the applicant submits that in pursuance to the tripartite agreement followed by the communication dated 18.12.2025, he is ready to handover a cheque of Rs. 50.00 lacs to the learned counsel appearing for the Bank in the open Court and such transaction may be recorded in the order. 5. We are afraid we cannot record such transaction which may taken place between the applicant and the Bank. If the issue has been settled by the Bank with the borrower as also with the applicant, it is for the parties to give effect to the agreement. 6. For us it is sufficient that the learned counsel appearing for the petitioners has submitted that the matter with the Bank has been amicably settled and he does not wish to pursue the petition. His statement is taken on record. 7. In view of the above, the writ petition bearing WP(C) No. 1530/2024 is dismissed along with connected CMs. (SANJAY PARIHAR) (SANJEEV KUMAR) JUDGE JUDGE SRINAGAR: 23.12.2025 “S. Nuzhat”
