ORAL ORDER (PER: HON'BLE MR JUSTICE VIJAYKUMAR A. PATIL)
This petition is filed alleging willful disobedience of the order of the learned Single Judge dated 05.10.2023 passed in W.P.No.202731/2023 (LA-RES), the operative portion of the order of the learned Single Judge reads as under:-
“It is the grievance of the petitioners that, the land belonging to the petitioners has been utilized by the respondent-authorities for construction of Bridge-cum-Barrage without initiating acquisition proceedings. In this regard, petitioners are permitted to make representation to the competent authority seeking redressal of their grievance and if such representation is made within two weeks from the date of receipt of certified copy of this order to the respondents 1 to 3 herein, the same shall be considered by the respondents 1 to 3 within eight weeks, thereafter. With these observations, the writ petition is disposed of.”

02. The respondents have filed an affidavit of Smt. Parvati Reddy, the Special Land Acquisition Officer, Kalaburagi.
03. The said affidavit is placed on record.
04. The said affidavit indicates that the State Government has passed an order as per Section 15 (2) and (3) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred as the ‘New L.A. Act’) and that she would prepare the final draft of the final notification to be issued under Section 19 (1) of the New L.A. Act and thereafter, take steps to pass an award and pay the compensation amount in accordance with law.
05. In view of the specific affidavit of the Special Land Acquisition Officer, the present contempt proceedings are dropped recording the undertaking.

06. It is needless to observe that if the respondents fail to adhere to undertaking, it is open for the petitioner to file a fresh contempt petition.
