This Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for quashing the entire proceedings of Criminal Case No.7108 of 2020, pending before the court of Additional Chief Judicial Magistrate/Vth Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar under Sections 342, 323, 325 and Section 506 of the Indian Penal Code, 1860. 2. Heard Mr. D.N. Sharma, learned counsel for the applicants, Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1 and Mrs. Manju Bahuguna, 1 2025:UHC:8597 learned counsel for the respondent no.2/informant- victim. 3. This fact is not disputed that the proceedings of said Criminal Case in relation to the co-accused Sukhvinder Singh have already been quashed by the Co- ordinate Bench of this Court in C 482 No.1813 of 2022. 4. All the Applicants-accused are present in- person. They are identified by Mr. D.N. Sharma, Advocate. 5. The respondent no.2/ informant-victim is present in-person. He is identified by Mrs. Manju Bahuguna, Advocate. 6. The respondent no.2 and the applicants submitted that there were some private disputes between them. They have settled their disputes and after resolving their disputes, they have filed a Compounding Application (IA No.1 of 2025) and affidavits with their free will and without any pressure. 7. The respondent no.2/informant-victim has requested to quash the entire proceedings of Criminal Case No.7108 of 2020. 8. The said request has not been opposed by the learned counsel for the respondent no.1. 9. In the facts and circumstances of the case, 2 2025:UHC:8597 ends of justice would be met if the entire proceedings of Criminal Case No.7108 of 2020, pending before the court of Additional Chief Judicial Magistrate/Vth Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar, are quashed. 10. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.7108 of 2020, pending before the court of Additional Chief Judicial Magistrate/Vth Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 24.09.2025 ALOK KUMAR VERMA, J.
