PUBLIC PROSECUTOR The Court made the following: EiE iiE= ORDER:- This Criminal Petition, under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short lthe BNSS') has been filed on behalf of the petitioner herein/accused No.5 to grant anticipatory bail in connection with crime No.78 of 2025 of Nunna Police Station, Vijayawada City, NTR District. 2. A case has been registered against the petitioner herein/accused No.5 and other accused for the offences Punishable under Section 143 of the Bharatiya Nyaya Sanhita, 2023 (for brevity lBNS') and Sections 81 and 87 of the Juvenile Justice (Care and Protection of Children) Act, 2015 (for brevity lthe JJ Actl 2015,). 3. Brief facts of the case of prosecution are that, prior to 01.03.2025 at Door No.77-44/1-3, Fire Station road, Prakash Nagar, Payakapuram, vijayawada, police found three (o3) infant babies in possession of accused Nos.1 to 5; that the police apprehended the accused, took custody of the babies, seized the Cash and Cell Phones in the Presence Of mediators under the cover of a Mediators Report; that on 13.03.2025 accused Nos.10 and 16 surrendered before police and that they were alleged to have made confession about the commission of crime and also about the alleged involvement of petitioner herel'n/accused No.5. On the 3 strength of mediators report, a case in Crime No.78 of 2025 of Nunna Police Station was registered for the aforesaid offences and investigated into. 4. Learned counsel for the petitioner herein/accused No.5 would contend that the` petitioner herein/accused No.5 was falsely roped into the crime-basing on the confession made by accused Nos.10 and 16. The petitioner herein/accused No.5 is running a marriage bureau an`d she is no way connected to the subject crime. 5. Learned Assistant Public Prosecutor for State submits that the investigation is pending and some more witnesses need to be examined to come to a conclusion about the role played by the petitioner herein/accused No.5. 6. Heard both sides. 7. A perusal of material on record goes to show that the subject crime was registered alleging that the petitioner herein/ accused No.5 along with other accused was allegedly procuring the children and selling them by receiving payments, for the purpose of exploitation, in order to have control over them. 8. A perusal of contents of the FIR goes to show that a boy was handed over to one Nagamani in the presence of petitioner herein/accused No.5. Px,-ma fac,-e there is no material to € 4 connect the petitioner herein/accused No.5 to the subject crime that she was benefited from any of the accused by doing the act of procuring the boy. In view of the aforesaid facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner herein/accused No.5, on certain conditions. 9. Accordingly, in the event of the arrest of petitioner herein/accused No.5 in the above crime, she shall be released on bail on her executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand) with two sureties each for the like sum to the satisfaction of the arresting police officials. Further, the petitioner herein/accused No.5 shall appear before the Station House Officer, concerned once in a week ,I.e. on every saturday in between 10.00 a.m. and 2.00 p.m. till filing of the charge sheet and further, the petitioner herein/accused No.5 shall make herself available for investigation as and when required and that she shall not cause any threat, inducement or promise to the prosecution witnesses. 10.
