By way of instant petition, the Petitioner is not challenging any specific order but is seeking for a direction to the learned Chief Judicial Magistrate, Bastar, Place Jagdalpur, District Bastar for speedy trial is being going-on vide Criminal Case No. 58/2024, State of Chhattisgarh Versus Suresh Kumar Dewangan and 03 others, arising out of the First Information Report No. 0065/2023, registered at Police Station Bastar, District Bastar for the offence VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.03.26 11:50:54 +0530 2 punishable Under Sections 498A, 323 and 34 of the Indian Penal Code, 1860, against the Petitioner and co-accused persons. The aforesaid case is pending before the learned Chief Judicial Magistrate, since 12.01.2024 and there is no effective progress in the matter. 2. Brief facts of the case are that, according to the prosecution story, the complainant (Namely Smt. Yogita Dewangan, W/o. Shri Suresh Dewangan - Petitioner and their marriage was solemnized on 20.11.2021) has filed a written report in the Police Station Bastar, District Bastar, alleging therein that she is the legally married wife of the Petitioner. When she was staying with her matrimonial home, her in-laws including the Petitioner had ill-treated thereby committed marpit, giving mental agony, physical torture etc. on account of demand of dowry. She was ousted from in laws house on 14.06.2023. The prosecution agency has registered the First Information Report No. 0065/2023 on 19.08.2023, for the offence punishable Under Sections 498-A, 323 and 34 of the Indian Penal Code, against the Petitioner and his other family members. 3. Thereafter the Station House Officer, Police Station through the Constable (Smt. Savita Mandavi No. 1167) had filed final report No. 02/2024, for the offence punishable Under Section 498A, 32, 34 of the Indian Penal Code, against the accused persons: Suresh Kumar Dewangan, Sanjay Kumar Dewangan, Dinesh Dewangan and Smt. Janki Dewangan on 12.01.2024 before the learned Chief Judicial Magistrate, Bastar, District Bastar (C.G.). 3 4. Learned counsel for the petitioner submits that the after filing of the charge-sheet on 12.01.2024, till date has neither recorded any statement of the witnesses not there is effective progress in the trial of Criminal Case No.58 of 2024. He made a limited prayer to expedite the trial pending before the concerned trial Court. 5. To the limited prayer that the petitioner has made, is not opposed by the learned State Counsel. 6. Considering the submission made by the learned counsel for petitioner that statement of the complainant has been recorded before the trial Court and the trial is in progress, therefore, the instant CrMP is disposed of with a direction that the trial Court shall conclude the trial expeditiously, if there is no legal impediment. 7.
