Roy Ms. Champa Pal … for the petitioner CAN 1 of 2024 is an application for recalling the order dated 25th September, 2024 passed in CO 569 of 2024 and for restoration of the application under Article 227 of the Constitution of India to its original file and number. After hearing the learned advocate for the petitioner and upon considering the averments made in the said application, this court is of the view that the petitioner was prevented by sufficient cause for not appearing when the civil revisional application stands dismissed for default. Accordingly, the order dated 25th September, 2024 stands recalled. The civil revisional application is restored to its original file and number. CAN 1 of 2024 stands disposed of. CO 569 of 2024 is taken up for immediate consideration. This is an application praying for an order directing the learned Additional District and Session (MACT) Judge, 2nd Court, Asansol to dispose 2 of the Motor Accident Claim Case No.59 of 2016 expeditiously. It appears from the record that 1st March, 2024 was fixed for evidence of PW1. Learned advocate for the petitioner submits that 25th March, 2025 has been fixed for evidence of PW1. In view of the order sought and proposed to be passed, there is no necessity of issuance of notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward the copy of this application and this order upon the opposite parties as well as the learned advocates appearing on their behalf in the learned trial court. In the light of the submission made by the learned advocate for the petitioner, CO 569 of 2024 stands disposed of with a request to the learned Additional District and Session (MACT) Judge, 2nd Court, Asansol to dispose of MAC Case No.59 of 2016 as expeditiously as possible without granting unnecessary adjournments to either of the parties. No order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon compliance of all necessary formalities. (Hiranmay Bhattacharyya, J.)
