JUSTICE PRAVEER BHATNAGAR
Order 01/04/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.362/2024 registered at Police Station Jawahar Nagar, Jaipur City (East) District Jaipur (East) for the offence(s) under Sections 190, 191(2), 191(3) and 109(1) of BNS and Section 3/25 of Arms Act.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that name of the petitioner is not mentioned in the FIR. FIR is lodged against four persons but no identification was conducted. Charge-sheet has already been produced before the concerned court. The accused petitioner is in custody since 05.12.2024 and
[2025:RJ-JP:14499] (2 of 3) [CRLMB-3817/2025] the trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner. Learned Public Prosecutor and learned counsel for the complainant opposed the bail application and contended that petitioner alongwith the other co-accused threatened the complainant and open fire out of her house, petitioner is a person having criminal antecedents and was found to be involved in seven other criminal cases, therefore his bail application deserves to be dismissed. Heard and perused the material available on the record. It is not desirable to express anything on the merits of the case. Considering the arguments raised by the counsel for the parties and looking to the period of custody and the fact that the trial of the case will take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Kundan Singh S/o Shree Ranjeet Singh, in connection with FIR No. 362/2024 registered at Police Station Jawahar Nagar, Jaipur City (East) District Jaipur (East) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every month. In case of any breach to the above condition, the
