The present petition has been filed with the following prayer: "1-issue an order or direction to court below I. e., Civil judge (Sinior division) Court No.15,, District- Sultanpur, to expedite the Application marked as a 6 ga 2 filed by the petitioner/plaintiff under order 39 rule 1 & 2 r/w 151 C.P.C. Which is pending in civil suit R.S no. 824/2023 Mohd. Jakariya versus Chhand Khan @ Chaand Mohammad Khan on date fixed i.e. 22.01.2025, pending before the learned civil judge (Sinior judge) Court No.15, District- Sultanpur. 2-Isuue an order or direction to the opposite party to maintain status quo in respect of property in dispute till the final disposal of application (T.I.) 6 ga 2 02.08.2023 dated filed by the petitioner/Plaintiff pending in the court below I.e. civil judge (S.D.) Court No15, District-Sultanpur, in civil case R.S No.824/2025, Mohd. Jakariya versus Chhand Khan @ Chaand Mohammad Khan and further direct to opposite they will not alienate in any manner the land in question of Gata NO. gata no. 125/0.6320hect, 126k/0.560 and 127kMi./0.5190hect/- total 3 gata total area 1.7150hect/- situated at Village-Pakdi, Pargana-Miranpur, Tahsil-Sadar, District- Sultanpur of his 1/5 share in the name of opposite party in the revenue record." 3. Considering the relief as sought only to the extent of prayer no.1, the present petition is disposed off directing the court concerned to consider and decide the aforesaid application filed under Order 39 Rules 1 and 2 in accordance with law with all expedition preferably within a period of six weeks from the date of production of a certified copy of this order.
