Abdul Baqee Khan, learned counsel appeared for the petitioners and Mr. Th. Vashum, learned GA appeared on behalf of the respondents No. 1 & 2. None appeared for respondents No. 3, 4 & 5. At the outset, the learned senior counsel appearing for the petitioners submitted that the petitioner will be satisfied if the present writ petition is disposed by directing the Additional Chief Secretary, Tribal Affairs & Hills Department, Government of Manipur and Member Secretary, Manipur State Commission for Scheduled Tribes (Respondent No. 2 herein) to consider the representation KABORA MBAM SAPANA CHANU Digitally signed by KABORAMBAM SAPANA CHANU Date: 2026.02.06 15:40:28 +05'30' Page 2 dated 04.08.2025 submitted by the petitioners on its own merit and strictly in terms of applicable rules and to dispose of the same by issuing a speaking order within a stipulated period. [2] Mr. Th. Vashum, learned GA appearing for the respondents No. 1 & 2 fairly submitted that as the prayer made on behalf of the petitioners is confined to the consideration and disposal of the representation submitted by him, he has no objection in disposing of the present writ petition as prayed for on behalf of the petitioners. However, the learned GA submitted that at the time of considering the said representation, the respondent No. 2 may be allowed to issue notice to respondents No. 4 & 5 for giving them an opportunity of being heard with regard to the said representation before taking any decision. [3] Considering the submission made by the learned counsel appearing for the parties, this Court is of the considered view that it will be in the interest of justice to issue the following directions:- 1) The Additional Chief Secretary, Tribal Affairs & Hills Department, Government of Manipur and Member Secretary, Manipur State Commission for Scheduled Tribes is hereby directed to consider the Page 3 representation dated 04.08.2025 submitted by the petitioners on its own merit and strictly in terms of applicable rules and to dispose of the same by issuing a speaking order. 2) It is made clear the respondent No. 2 should give notice to respondents No. 4 & 5 for giving them an opportunity of being heard at the time of consideration of the said representation and before taking any decision. 3) The whole process should be completed within a period of 3 months from the date of receipt of a certified copy of this order. [4] The above directions have been given without considering the merit of the present writ petition. [5] With the aforesaid directions, the present writ petition is disposed of. JUDGE Sapana
