Heard learned counsel for the petitioner and Mr. Hari Om Singh, learned Standing Counsel for the State-respondent and Mr. Azad Rai, learned counsel for Gaon Sabha. 2. The instant petition has been filed for following relief:- I. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent No. 2/ Additional Commissioner-1st, Prayagraj Mandal, Prayagraj, to decide the Appeal No. RST No. 1181 of 2021, Computerized Case No. C2021102000001181 (Pitambar vs. Shivram and others), under Section 210 of the U.P. Land Revenue Act, 1901, within stipulated period as fixed by this Hon'ble Court. 3. Learned counsel for the petitioner submitted that appeal filed on behalf of petitioner under Section 210 of U.P. Land Revenue Act is pending before respondent No. 2, Additional Commissioner-1st, Prayagraj Mandal, Prayagraj, since 2021. He further placed a certified copy of the order-sheet of the proceeding, which is annexed as annexure-2 to the writ petition in order to demonstrate that the aforementioned matter is not proceeding expeditiously. 4. Considering the facts and circumstance of the case, the instant petition is finally disposed of directing the respondent No. 2/ Additional Commissioner-1st, Prayagraj Mandal, Prayagraj, to decide the aforementioned appeal after affording proper opportunity of hearing to the parties expeditiously, preferably, within a period of two months from the date of production of a certified copy of this order before him.
