Neutral Citation No. - 2025:AHC-LKO:2371-DB Court No. - 2 Case :- WRIT - C No. - 296 of 2025 Petitioner :- Chheeteshvar Gupta Respondent :- State Of U.P. Thru Addl.Chief Secy./Prin.Secy. Deptt. Of Urban Development Lko And Ors. Counsel for Petitioner :- Sajjad Husain Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard. The petitioner alleges that his shop was taken over by the opposite parties for construction of Rampath at Ayodhya and an amount of Rs. 2,00,000/- and one shop was promised to all the shop owners whose shops were taken over, but while the others have been paid the said amount and the shop has also been given, so far as the petitioner is concerned, only Rs. 50,000/- has been paid, hence this petition. On being asked to show such assurance given by the opposite parties in writing, the Counsel could not show it, however, he relied on paragraph 9 of his petition. Per contra, Shri Manish Mishra, learned Standing Counsel says that petitioner did not have any permanent shop at the place in question, however, he had a tin shed in between two shops and used to sell vegetables and therefore, on the saying of the adjoining shop holders, as the petitioner was also selling vegetables, an amount of Rs. 50,000/- was paid to him but he is not entitled to the amount as claimed. This is not a matter where the High Court will interfere under Article 226 of the Constitution of India, as, it involves factual disputes. Petitioner may avail other remedies. The writ petition is disposed of in the aforesaid terms.
