W.P(MD)No. 1104 of 2023 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED :22.09.2025 CORAM: THE HONOURABLE MR JUSTICE SENTHILKUMAR RAMAMOORTHY W.P(MD)No. 1104 of 2023 N.Subbiah ... Petitioner Vs The District Revenue Officer, Sivagangai, Sivagangai District. ... Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for records relating to impugned proceedings made by the respondent in Pa.Mu. P4-1338-2022 dated 16.11.2022 and quash the same and consequently, direct the respondent to enter the name of Nachiappa Chettiar Son of Palaniappa Chettiar in respect of Patta No. 470, K. Nerpugapatti Group Village, Karaikudi Taluk, Sivagangai District. For Petitioner : Mr. B.Ponnupandi For Respondent : Mr.M.Muthumanikkam Government Advocate O R D E R An order dated 16.11.2022 of the District Revenue Officer, Sivagangai, is challenged in this Writ Petition on the ground that the 1/6 https://www.mhc.tn.gov.in/judis W.P(MD)No. 1104 of 2023 petitioner was not provided a reasonable opportunity and on the ground that the impugned order itself records that an error had been committed during updation under the UDR scheme. 2. Learned counsel for the petitioner invited my attention to the operative paragraph of the impugned order and pointed out that such order itself records that in the settlement 'A' register, the pattathar's name was recorded as Nachappa Chettiar, son of Palaniappan Chettiar, whereas in the UDR records, it was erroneously recorded as Palaniappan Chettiar's son Namasivayam. 3. Learned Special Government Pleader submits that the impugned order was issued upon noticing that lands in survey Nos.109/15, 124/17, 186/4 and 189/31 were transferred by Palaniappan Chettiar to Amravati. 4. Upon perusal of the impugned order, it is noticeable that the petitioner's request for rectification of UDR records relates to 19 survey numbers, including survey Nos.109/15, 124/17, 186/4 and 189/31. In the impugned order, in relevant part, it is recorded as under: 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No. 1104 of 2023 “Nkw;gb tpguq;fspd;gb fhiuf;Fb tl;lk;> Nf.new;Gf;fg;l;b F&g;G gl;lh vzp 159-y; gl;lhjhuu; ngau; godpag;gr; nrl;bahu; kfd; ehr;rpag;g nrl;bahu; vd epytupj;jpl;l gjpNtLfspYk;> 159ehr;rpag;gnrl;bahu; vd;W nrl;by;nksl; "m" gjpNtLfspy; jhf;fyhfp> gpd;du; eilngw;w UDR; jpl;l fhyj;jpy; gl;lh vz; 470-y; gl;lhjhuu; ngau; godpag;gr; nrl;bahu; kfs; ekr;rpthak; vdf; fpuhkf; fzf;F kw;Wk; fzpdp fzf;Ffspy; jtWjyhf jhf;fyhfpAs;sJ. As is noticeable from the above extract, merely on the ground that lands in Survey Nos.109/15, 124/17, 186/4 and 189/31 were conveyed by Palaniappan Chettiar to Amravati without providing any basis therefor, the request of the petitioner was rejected in respect of all 19 survey numbers. As contended by learned counsel for the petitioner, the impugned order records that the settlement 'A' register stood in the name of Nachappa Chettiar and that the UDR records recorded the pattathar's name as Namasivayam. 6. In these circumstances, a case is made out for reconsideration by the District Revenue Officer. Therefore, the impugned order dated 16.11.2022 is set aside and the matter is remanded for reconsideration. After providing a reasonable opportunity to the petitioner and any other persons interested in the relevant lands, a fresh order shall be issued within a period of twelve (12) weeks from the date of receipt of a copy of this order. 7. Accordingly, this Writ Petition is allowed. No costs.
