JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 16-10-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) & 56 (b) of the Bihar Prohibition and Excise Act. 3. The case of the prosecution is that altogether 123.12 liters of country made foreign liquor were recovered from a Pickup Van. 4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that the petitioners are the driver and co-driver of the vehicle, in question. It is further contended that they had no knowledge Patna High Court CR. MISC. No.73113 of 2025(2) dt.16-10-2025 2/2 regarding the presence of the alleged liquor kept in the said vehicle. Moreover, the petitioners are languishing in judicial custody since 01.09.2025 having no criminal antecedent. 5. Learned APP appearing for the state has opposed the prayer of regular bail. 6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Patna Excise P.S. Case No. 1446 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise – III, Patna.
