2025:JHHC:18594 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3673 of 2025 1.Sanjit @ Sanjib Prasad Noniya, S/o Sadhu Noniya 2.Golu @ Rudra Kumar Noniya, S/o Sanjib Prasad Noniya, both R/o Village- Sodepur, P.O. Radhanagar, P.S. Kulti (M), District- Burdhman (West Bengal) .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). …… CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Nityanand Prasad Choudhary, Advocate For the State : Mr. Shree Prakash Jha, AddI. P.P. …...... 06/ 10.07.2025: Defect(s) as pointed by the Office is ignored for the present. 2. Heard, learned counsel for the petitioners and learned counsel for the State. 3. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioners apprehending their arrest for offences under Sections 303(2), 317(2), 3(5) of B.N.S., 2023 (u/s 379, 411/34 of IPC). 4. The allegation in the F.I.R. is that one boy was caught when he stolen a mobile. On query, he stated that it is these petitioners and others, who had brought the boy and also use him to bring other children for the purpose of committing theft. 5. Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. and their name only transpired on the submission of the boy who was arrested while stealing the mobile. 6. This is a case where petitioners and others alleged to have been involved in training young children to commit theft of mobiles and other articles. They also deploy young children to commit the crime Thus, this case needs custodial interrogation. 7. Considering the nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioners. 8. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Kundahit P.S. Case No.51 of 2024, pending in the Court of learned A.C.J.M., Jamtara, stands rejected.
