2025:UHC:8650-DB HIGH COURT OF UTTARAKHAND AT NAINITAL HON’BLE THE CHIEF JUSTICE MR. G. NARENDAR AND HON’BLE SRI JUSTICE SUBHASH UPADHYAY 25TH SEPTEMBER, 2025 SPECIAL APPEAL NO. 312 OF 2025 Pradeep Kumar
…...Appellant. Versus State of Uttarakhand & others
….Respondents.
Counsel for the Appellant : Mr. Harendra Belwal, learned counsel. Counsel for the State : Mr. J.S. Bisht, learned Standing Counsel.
JUDGMENT :(per Mr. G. Narendar, C.J.)
Heard learned counsel for the appellant and learned Standing Counsel for the State.
2.
We have perused Paragraph Nos.5 and 6. The learned Single Judge has found that the petitioner has got extended his services in Haridwar and circumvented his transfer order by more than two years under the cover of an interim order granted by this Court.
3.
On a query, the learned counsel for the appellant would fairly admit that the appellant has been serving in Haridwar since 2017. In all, the appellant has spent about eight years and the reason for the transfer is that the strength in Haridwar does not warrant additional hands, and the strength of students in Pithoragarh being excessive and proportionately lesser number of teachers being available 1
2025:UHC:8650-DB there, the transfer was made.
4.
In that view, we do not find any error in the
order under challenge. The reasons fully justify the order. We are of the opinion that the instant appeal is wholly bereft of merit and, is accordingly, rejected.
5.
Pending application, if any, also stands disposed of.
