This criminal miscellaneous petition has been filed under section 528 B.N.S.S. by the petitioner with a prayer for modification of the order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025. It is submitted by the learned counsel for the petitioner that the petitioner was given the privilege of anticipatory bail vide order dated order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 on showing the proof of deposit of Rs.28,000/- with the DFO, Koderma Forest Division. It is next submitted that due to printing mistake, in the order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 “DFO, Koderma Forest Division” has been mentioned instead of “Divisional Forest Officer, Wildlife Division, Hazaribagh” and because of the same, the petitioner could not surrender within the stipulated time. It is next submitted that the said order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 be suitably modified and the time to surrender before the court below in terms of the said order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 be extended for six weeks from the date of this order. Considering the aforesaid submission of the learned counsel for the petitioner, the order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 is modified to the extent that the words “DFO, Koderma Forest Division” as mentioned in the said order be read as “Divisional Forest Officer, Wildlife Division, Hazaribagh” and the prayer for extension of time for 6 weeks for the petitioner to surrender in the court below in terms of the order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 is allowed. Hence, the petitioner is directed to surrender before the court below “within six weeks from the date of this order in terms of the order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025”. The order dated 26.03.2025, passed in A.B.A. No. 1951 of 2025 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly. (Anil Kumar Choudhary, J.)
