There is already a civil dispute pending between the petitioner and private opposite parties relating to Gata No. 326 and 327. During its pendency it is alleged that opposite parties no. 6 and 7 have thrown garbage on Gata No. 328 which is just in front of the petitioner's house. 4. It is hardly a matter which is amenable to writ jurisdiction under Article 226 of the Constitution of India. 5.
